La Révolution française et l'enseignement primaire. Leçon d'ouverture.

Les « grands ancêtres » de la Révolution ont considéré que l'éducation des jeunes constituait un enjeu essentiel pour la consolidation de la République. Ils constatent sans regret que les institutions d'Ancien Régime dépérissent et ils entendent leur substituer un système nouveau, assurant la formation de « bons citoyens », grâce à des instituteurs et professeurs « bons patriotes » et à des manuels conformes aux objectifs du régime. Les plans d'éducation nationale se succèdent, comme les majorités politiques. Celui de Talleyrand n'est pas discuté (1791). Celui de Condorcet (1792) non plus, mais il inspirera l'œuvre scolaire de la IIIe République. Le plan Lepelletier, le plus radical (1793), prévoyait d'enlever les enfants à leur famille, pour en faire de bons républicains par la vie et le travail en commun, de 5 à 12 ans. Le plan Bouquier correspond à la période de dictature jacobine ; le plan Lakanal, à la période thermidorienne. Il souhaite améliorer la qualité de l'enseignement par un recrutement sérieux des instituteurs (17 novembre 1794). Avec la loi Daunou, votée par la Convention à la veille de se séparer (25 octobre 1795) et qui régira le système jusqu'au Consulat, on revient à la solution d'Ancien Régime : les maîtres seront rétribués par les familles, outre un minimum versé par la commune. La succession des projets ne modifie pas la permanence des objectifs : mettre à la disposition de tous les enfants une formation de bon niveau, leur permettant d'assumer leur fonction d'homme et de citoyen. En fait, la vie des écoles se heurte à de multiples difficultés : manque de locaux, de moyens matériels, de personnel qualifié. En outre, beaucoup de parents ne font pas confiance à l'école « sans Dieu » de la République et préfèrent recourir aux maîtres et maîtresses qui pratiquent l'éducation traditionnelle (et religieuse), dès que le retour à la liberté de l'enseignement (1795) permettra leur existence. En beaucoup de lieux, école « tricolore » et école « crypto catholique » coexistent, non sans rivalités. La géographie de la réussite ou de l'échec de l'école républicaine correspond à celle de l'enracinement, ou non, des valeurs révolutionnaires. Réussi dans le Nord, l'Est, la Charente ; médiocre dans l'Ouest, le Centre, le Midi. Les révolutionnaires ont maintenu le cap de l'objectif politico-culturel : faire de l'école populaire le lieu de démocratisation des connaissances et de formation idéologique des futurs citoyens. Cette ambition et les instituteurs « patriotiques », inaugurent la politique enracinant à gauche la tradition scolaire française.

The French Revolution and primary school education : opening lecture.

The « forefathers » of the French Revolution considered that the education of young people was an essential element for the consolidation of the Republic. They note without regret that the institutions of the Ancien Régime were coming to an end, and they intend to replace them with a new system, thus insuring the training of « good citizens » thanks to elementary and secondary school teachers who are « good patriots » and to school manuals which comply with the objectives of the government. Schemes for the national educational system follow one another just as the political majorities do. Talleyrand's proposal is not discussed (1791). Neither is that of Condorcet (1792), but it will inspire the school organization of the Third Republic. Lepelletier's program (1793), the most radical of them all, planned to take children between the ages of five and twelve from their families in order to make good republicans of them through their living and working together. Bouquier's program corresponds to the period of the Jacobin dictatorship ; Lakanal's to the Thermidorian period. He wanted to improve the quality of education through a serious recruitment of primary school teachers (17 November 1794). With Daunou's law, approved by the Convention on the eve of its dispersal (25 October 1795) and which will control the system until the Consulat, we can see a return to the system of the Ancien Régime : the teachers are supported by the families in addition to being paid a minimum salary by the commune. The succession of programs does not change the continuity of these objectives : put a good educational program at the disposal of all children thus allowing them to assume their role of men and citizens. In fact life at school is confronted with numerous difficulties : the absence of classrooms, materials and qualified personnel. In addition, many parents do not trust the school « without God » of the Republic, and prefer to turn to traditional teachers who practice traditional (and religious) education as soon as the freedom of the choice of education (1795) allows them to exist. In many places, the « tricolor » (revolutionary) and the « crypto-catholic » schools co-exist, but not without rivalry. The geography of the success or the failure of the republican school corresponds to that of the implantation or not of revolutionary values. A success in the North, the East and in the region of Charente ; it is only mediocre in the West, the Center and the South. Those in favor of the French revolution maintained the political and cultural objective of making the school for the people a place of the democratisation of knowledge and of the ideological training of future citizens. This objective, and the « patriotic » primary school teachers were the beginning of the policy which deeply roots the French school tradition to the left.

Le silence des sources, comme autre source. Réflexions sur la formation des juristes à l'époque du droit des juristes romain.

Les sources qui nous renseignent sur la formation des juristes romains à l'époque classique sont très peu nombreuses. En admettant l'hypothèse qu'il existe dans chaque culture juridique un rapport entre la genèse du droit et la formation des spécialistes du droit, il est possible de cerner les grandes lignes de l'enseignement du droit classique. Nous procéderons ici en trois étapes. Nous envisagerons d'abord le rôle des juristes romains lors de l'élaboration et du perfectionnement du droit. De ce rôle, nous déduirons ensuite les conditions présidant à l'organisation interne du groupe des juristes. Ce n'est, enfin, que sur cette base qu'il sera permis de définir les caractéristiques de la formation des futurs juristes. Nous pourrons alors constater que le droit des juristes à Rome n'a pu se développer de façon continue sur plusieurs siècles qu'en raison de l'étroitesse et de l'extrême homogénéité sociale du groupe des juristes responsables du développement du droit. La formation des juristes avait pour but de créer des juristes capables de s'intégrer dans tous les domaines de leur existence professionnelle au groupe des juristes existants. C'est pourquoi l'enseignement du droit à l'époque classique se déroulait dans le cadre d'une relation personnelle entre un maître, juriste pratiquant, et son disciple, et non dans un cadre institutionnalisé. Et c'est justement parce que cette éducation était privée et unique que nous ne possédons que très peu de sources nous renseignant sur la formation des juristes romains d'alors.

The silence of sources considered as another source. Thoughts about the training of jurists at the time when the law of Roman jurists prevailed.

There are very few sources of information about the training of Roman jurists during the classical era. If we accept the hypothesis that there exists in each legal culture a link between the genesis of the law and the training of specialists of that law, it is possible to define the main lines of the teaching of classical law. This study includes three main points. First of all, we can consider the role of Roman jurists during the development and the perfection of the law. In this role, we can then infer the conditions preceding the internal organization of the group of jurists. It is finally only on this basis that we will permit ourselves to define the characteristics of the training of the future jurists. We could then notice that the law of the jurists in Rome was only able to expand continuously over several centuries because of the narrowness and the extreme social homogeneity of the group of jurists responsible for the development of the law. The training of jurists was aimed at creating jurists capable of integrating well into all the professional realms of the group of existing jurists. This is why the teaching of law during the classical era took place in a personal relationship between a master, a practicing jurist, and his disciple and not within the framework of an institution. And it is precisely because the education was private and on a one-to-one basis that we only have at our disposal very few sources informing us about the training of the Roman jurists during the period of time in question.

Un aperçu de l'enseignement du droit au Moyen Âge : les Lecturae super codicem d'Odofrède et de Jacques de Révigny.

S'inscrivant dans la Renaissance intellectuelle des xiie et xiiie siècles, les lecturae du maître bolonais, Odofrède, et du maître orléanais, Jacques de Révigny, sont des œuvres didactiques qui, chez l'un comme chez l'autre, présentent à peu près les mêmes caractéristiques de clarté et de précision, de concision et de bon sens, avec seulement quelques nuances tenant à leur tempérament respectif. Le code de Justinien constitue la base de leur enseignement et leur méthode offre également de grandes ressemblances : explication littérale de la matière juridique, recours aux procédés de la dialectique médiévale, distinctions et subdivisions, enchaînement dans un ordre variable des exemples concrets, des interrogations et de toutes les contradictions possibles, casus, notabilia, quaestiones, oppositiones. Respectueux de la doctrine, ils savent aussi la critiquer, la combattre et s'en démarquer à l'occasion. Sensibles à la contingence du droit, ils prennent soin de noter les variations des règles juridiques résultant des lieux, des époques et des milieux sociaux, dans lesquels on vit ou auxquels on appartient. L'un comme l'autre sont à l'écoute des soucis et des souhaits de leurs contemporains. Cela fait que leur enseignement est largement ouvert aux problèmes de la vie de tous les jours.

A survey of the teaching of law in the Middle Ages : the Lecturae super codicem by Odofrede and Jacques de Révigny.

Coming within the scope of the intellectual Renaissance of the twelfth and thirteenth centuries, the Lecturae by Odofrède, the master from Bologna, and by Jacques de Révigny, the master from Orléans, are didactic works which, one as well as the other, present almost the same characteristics of clarity, preciseness and conciseness, as well as good sense, with just a few slight differences due to the respective personalities of the authors. The Justinian code constitutes the basis of their teaching and their method is quite similar to each other's : literal explanation of legal subjects, use of the procedures of medieval didactics, divisions and subdivisions, linking in variable order concrete examples, questions and all possible contradictions : casus, notabilia, quaestiones, oppositiones. Although they show great respect for the doctrine, they also are able to criticize it, to resist its influence, and to differentiate themselves from it when the occasion arises. Sensitive to the contingency of the law, they carefully note the variations in legal rulings resulting from differences in place, in time and in social class in which people live or to which they belong. They each, one as much as the other, lend an ear to the concerns and the wishes of their contemporaries. The result is that their teaching is widely open to the problems of everyday life.

La « nation » des Bourguignons à l'Université des droits de Montpellier (XIVe siècle).

Selon les termes de statuts octroyés en 1339, l'Université des droits de Montpellier réserve le tiers des sièges, dans son conseil, à la « nation » des Bourguignons (qui inclut notamment Lyon, Lausanne et la Savoie). Presque tout au long du xive siècle, les Bourguignons fréquentent massivement les universités méridionales, surtout Avignon et Montpellier. Mais leurs effectifs diminuent dès 1393, et se raréfient après 1400, les choix se portant désormais sur Orléans et Paris. Contrairement aux Lorrains et aux étudiants des Pays-Bas, les Bourguignons sont en majorité des romanistes. L'explication de cette particularité reste délicate. Ce choix suppose en tout cas des origines sociales aisées.

The « nation » of Burgundians at the University of Law in Montpellier (fourteenth century).

According to the terms of the statutes of 1339, the University of Law in Montpellier reserved a third of the seats in its Board of Administration for the « nation » of the Burgundians (which notably includes Lyon, Lausanne, and Savoy). Throughout most of the fourteenth century, Burgundians are massively enrolled in southern universities, especially in Avignon and Montpellier. But their numbers diminish after 1393 and even become rare after 1400, as they thus choose to enroll in the universities in Orléans and Paris. Unlike the people of Lorraine and students from the Netherlands, Burgundians are for the most part romanists. It is difficult to explain this particularity. In any case the choice implies well-to-do social classes.

De l'école à l'université. Dans l'espace bourguignon et romand (XIIe-fin XVe siècle).

Dès le xiie siècle alors que le réseau urbain s'étoffe, parallèlement à des besoins nouveaux, naissent et se multiplient écoles et universités. L'Église, dès les conciles de Latran III et IV, a insisté sur la nécessité d'implanter ces écoles auprès des églises cathédrales, mais aussi dans les simples paroisses et de les pourvoir en maîtres compétents. Au sein de ces diverses écoles, maîtres et élèves prirent conscience qu'ils avaient des intérêts communs et qu'ils constituaient une universitas. L'université allait naître. Ce passage de l'école à l'université, non effectif pour tous, permettant la formation des élites, cette mutation scolaire toucha les espaces bourguignons et romands du xiie au xve siècle. Toutefois, comme le souligne Jacques Verger par ailleurs, plus encore peut-être dans cet espace de part et d'autre du Jura, la dispersion et l'indigence, l'information fragmentaire des sources rendent cette approche difficile. Cependant, par le nombre des écoles, en raison du rôle joué par l'Université de Dole fondée en 1422, en observant le mode de recrutement des maîtres et professeurs, les conditions faites à ceux-ci et à l'enseignement, les enfants et adolescents de ces régions s'ouvrirent à la lecture, l'écriture, au savoir savant. Cet essor culturel a bien permis la promotion sociale d'une élite qui servit les corps de ville, mais aussi les États des ducs Valois et le pays de Vaud.

From school to university. In Burgundy and French-speaking Switzerland (from the twelfth to the late fifteenth centuries).

As early as the twelfth century while the urban network is developing at the same time as new needs, schools and universities are established and multiply. The Church, from the time of the Councils of Latran III and IV, not only emphasized the necessity of setting up schools near cathedrals but also within simple parishes and supplying them with competent schoolmasters. In the framework these different schools, schoolmasters and pupils became aware that they had common interests and that they constituted a universitas. The university was to be born. The transition from the school to the university, which was not the case in all situations, allowing for the training of the elite, this transformation in the academic world stretched from Burgundy to French-speaking Switzerland extending from the twelfth to the fifteenth centuries. However, as Jacques Verger stresses elsewhere, perhaps still more often in this area from one end of the Jura to another, dispersion and poverty, and the fragmentary sources of information make this approach difficult. However, through the number of schools, and due to the role played by the University of Dole founded in 1422, by observing the recruiting methods of schoolmasters and teachers and the conditions available to them as well as to education itself, the children and adolescents of these regions open up to reading, writing and scholarly learning. This cultural expansion well and truly permitted the social ascension of an elite that served not only the city governments but also the Etats des ducs Valois and the Pays de Vaud.

Disputations en droit à l'Université de Cambridge sous le règne élisabéthain.

Nos connaissances sur l'enseignement juridique à Cambridge sous le règne élisabéthain et au temps des premiers Stuart sont très fragmentaires. Les quelques sources qui nous sont parvenues n'apportent guère d'éclaircissements sur la manière dont un enseignement suivant l'ordo legalis du Corpus iuris civilis se serait réellement maintenu, ou sur les cours pour juristes dispensés dans certains collèges. Les statuts de l'époque élisabéthaine ne contiennent en général que des dispositions sur l'organisation de l'enseignement et font ressortir l'importance, tant pour la faculté de droit que pour les autres facultés, des disputations comme une épreuve essentielle dans la formation et l'évaluation des étudiants. À peine quelques sujets de disputations de cette époque nous sont connus ; dans quelques cas, les titres de ces disputations sont conservés avec les vers qui étaient composés à une telle occasion, mais nous ne disposons ni de transcriptions, ni de version rapportées des disputations elles-mêmes. Toute appréciation de la formation juridique à Cambridge durant cette période devra par conséquent tenir compte d'informations indirectes. Pourtant, les sujets des disputations (dont une liste est présentée en annexe au présent article) révèlent dans une certaine mesure quels types de questions faisaient l'objet de disputations (et quels autres types de questions étaient apparemment omis), quelles sources (doctrinales ou textuelles) prédominaient et quelles questions en rapport avec le droit étaient parfois traitées dans des disputations d'autres facultés.

Legal Disputations in Elizabethan Cambridge.

Little is known about legal education at Cambridge in late-Tudor and early-Stuart times. There is little evidence whether a curriculum based on the ordo legalis of the main collections of the Corpus iuris civilis was actually taught, and what emphasis there may have been in legal classes provided by some of the Colleges. The Elizabethan statutes only provide some indications as regards the organisation of legal studies, from which it appears that, as in the other faculties, disputations played an important role in the training and formal assessment of students. Again, only a few titles of disputations have survived ; sometimes, these appear with the verses that were composed on such occasions, but no transcripts or edited versions of the actual disputations seem to have been preserved. Any insight in the legal education of Cambridge men will therefore largely depend on circumstantial evidence. Even so, the titles of the disputations (of which a list is presented in the Appendix to the present paper) reveal to some extent what kind of topics were discussed (and which topics apparently not), what kind of legal authorities prevailed, and which questions related to law were sometimes included in disputations of other faculties.

Quelques aspects de l'éducation, de la culture et de l'activité intellectuelle des juristes bourguignons à la fin de l'Ancien Régime.

Le monde des juristes a tenu en Bourgogne un rôle de premier plan à toutes les époques. Cette renommée s'explique d'abord par l'instruction rigoureuse qu'ils recevaient, chez les Jésuites, pour l'enseignement de base, dans les universités françaises et étrangères, à la faculté de droit de Dijon, quand elle fut créée en 1722, et enfin dans leurs familles, comme auprès de leurs confrères, pour la formation juridique. Ce savoir acquis, ils avaient à cœur de le partager et d'en faire profiter les plus jeunes, en ouvrant leurs bibliothèques et leurs cabinets d'études, en tenant des académies et en composant des œuvres d'érudition, d'histoire et de droit. Soucieux de défendre les particularismes de la province, ils savaient cependant s'ouvrir sur le monde et rayonnaient au-delà même des frontières du royaume.

Aspects of the education, the culture and the intellectual activity of Burgundian jurists at the end of the Ancien Régime.

Jurists in Burgundy have been very influential down through history. This reputation can be explained firstly by the rigorous basic education they received at Jesuit schools followed by their legal training in French and foreign universities, and at the Faculty of Law in Dijon established in 1722, and finally from their families and their colleagues. They greatly wanted to share the knowledge that they had acquired with younger people and have them benefit from it by opening their libraries and their legal offices, by taking charge of the académies and by writing works of erudition, history and law. Concerned about defending the particularities of their province, they, however, were able to remain open to the world and had an important influence even beyond the borders of the kingdom.

Michel Joseph Antoine Servan (1737-1807), ses idées sur l'enseignement et l'éducation — De l'esprit des Lumières à des conceptions plus traditionnelles.

L'avocat général dauphinois Michel Joseph Antoine Servan (1737-1807), dont la renommée a égalé celle de Mirabeau au xviiie siècle, se préoccupa d'enseignement et d'éducation. L'influence des Lumières fut déterminante quant à sa pensée. Critique vis-à-vis des Jésuites, soutenu par les Encyclopédistes, ami de Voltaire, il admirait la Chine et magnifiait l'esprit de famille. Il critique fermement les défauts de l'enseignement supérieur au xviiie siècle, en particulier dans les facultés de droit. Admirateur de Frédéric II de Prusse et de l'enseignement en Allemagne, Servan est connu aussi bien en ce pays qu'en Suisse, aux États-Unis et en Russie. Opposé à l'enseignement du droit en langue latine, il est favorable à l'éducation publique. Dès 1781, puis en 1789, il conçoit l'éducation comme l'école du patriotisme, à l'égal de Rousseau qu'il a connu en 1768. Mais son action en faveur du rôle des femmes en politique, il la tient de Lessing. Une lettre manuscrite retrouvée au Fonds dauphinois de la Bibliothèque municipale de Grenoble, nous éclaire sur son admiration pour des expériences anglaises d'enseignement, de même pour l'éducation à Genève et pour l'« État intérieur » à Berne. Correspondant de Rœderer et de Neufchâteau, Servan aussi connut en Suisse le pédagogue Pestalozzi et peut-être Stapfer. Commentateur de Montaigne, il tente de définir l'éducation et soutient l'enseignement du grec ancien et des langues vivantes. La place de l'avocat général Servan dans l'Europe des Lumières mérite d'être redécouverte.

Michel Joseph Antoine Servan (1737-1807), his ideas on teaching and education — From the spirit of the Enlightenment to more traditional conceptions.

The avocat général (prosecuting attorney) from the Dauphiné region, Michel Joseph Antoine Servan (1737-1807), whose reputation was equal to that of Mirabeau in the eighteenth century, was concerned with teaching and education. The influence of the Enlightenment was a determining factor in forming his way of thinking. Critical towards the Jesuits, supported by the Encyclopedistes, a friend of Voltaire's, he admired China and glorified the family. He greatly criticizes the imperfections of higher education in the eighteenth century, in particular in the Faculties of Law. An admirer of Frederick II of Prussia and of the educational system in Germany, Servan is known as well in there as he is in Switzerland, in the United States and in Russia. Opposed to the teaching of law in Latin, he is favorable to public education. As early as 1781, then in 1789, he sees education as the school of patriotism, as did Rousseau, whom he had met in 1768. However, his actions in favor of women's role in politics were influenced by Lessing. A handwritten letter found in the Fonds Dauphinois in the municipal library in Grenoble helps explain to us his admiration for experimentation in the english education system, as well as for education in Geneva and for the « État intérieur » in Berne. A correspondent of Rœderer and of Neufchâteau, Servan also made the acquaintance of the pedagogue Pestalozzi and perhaps Stapfer in Switzerland. As a commentator of Montaigne, he tried to define education and he supported the teaching of ancient Greek and modern foreign languages. His place as avocat général in the Europe of the Enlightenment deserves rediscovery.

À propos de la formation juridique du clergé diocésain sous l'Ancien Régime.

Alors que la Réforme catholique ne cherche nullement à promouvoir les disciplines juridiques dans la formation du bas clergé, les clercs et futurs prêtres diocésains trouvent certains avantages à obtenir une formation en droit, en droit canonique essentiellement. En Bourgogne, les clercs qui passent par le collège des Jésuites de Dijon sont au contact des matières juridiques, bien présentes parmi les ouvrages de la bibliothèque de l'établissement. Les clercs y ont accès à plusieurs traités pratiques quant à leur future situation de titulaires de bénéfices ecclésiastiques. Surtout, les prêtres bourguignons savent trouver dans les diplômes universitaires des avantages professionnels (avec l'expectative des gradués). De plus, les études de droit semblent être, au xviiie siècle, un vecteur de promotion sociale pour les prêtres issus de catégories « populaires ». Si le clergé n'offre que peu de postes qui obligent à une formation poussée en droit (official, conseiller-clerc...), l'augmentation notable des charges du clergé paroissial à l'époque moderne rend utile, sinon nécessaire, de connaître le droit, canonique mais aussi pénal, principalement du fait des charges de police et de justice (notamment le monitoire à fin de révélations) qui leur incombent désormais.

The legal training of the diocesan clergy under the Ancien Régime.

Where as the catholic Reformation did in no way encourage the lower clergy's training in legal subjects, clerics and future diocesan priests had certain advantages if they obtained training in law, especially in canon law. In Burgundy, the clerics who studied in the Collège des Jésuites in Dijon were exposed to legal subjects, which were well represented in the works of the library of the institution. Clerics had access to many practical treatises concerning the ecclesiastic advantages of their future positions. Above all, Burgundian priests were able to gain professional advantages by obtaining university degrees (with the expectation of reaching a higher rank). In addition, in the eighteenth century, legal studies seemed to be a medium of climbing the social ladder for priests from the lower classes. If there were few positions in the clergy that required advanced training in law (« official », counsellor-cleric...) the great increase in the obligations of the parish priest in modern times has made it useful, if not necessary, to know the law, not only canon law but also criminal law, principally due to their functions in the realms of policing and justice (notably during the « monitoire » for the purpose of revealing misdeeds) which would from then on be their responsibility.

Les juristes nivernais et l'ancienne Université de Bourges (ébauche d'une recherche).

Il n'y a pas eu d'enseignement juridique à Nevers avant la fin du xxe siècle, si l'on néglige des épisodes sans lendemain. Les juristes nivernais devaient donc aller étudier le droit ailleurs. L'Université de Bourges, toute proche, créée à la fin du xve siècle, et qui jouissait d'un grand prestige, en a attiré un certain nombre, un nombre qu'il est impossible de connaître avec certitude. D'autres ont fréquenté à la Faculté de droit de Paris. L'examen des cours des professeurs de droit français de Bourges montre qu'ils n'accordaient pas une place à part au droit nivernais, soucieux qu'ils étaient avant tout d'enseigner le droit commun coutumier.

Legal specialists of the region of Nevers and the former University of Bourges (a preliminary piece of research).

There was no legal training in Nevers before the end of the twentieth century, if we do not consider the periods during which there were unsuccessful beginnings of such studies. The people from this region who wanted to study law had to go elsewhere. The University of Bourges, only a short distance away, was created in the late fifteenth century. It had a very prestigious reputation and attracted quite a few students from the region in question, but it is impossible to know the exact number. Others went to study law at the Faculty of Law in Paris. An examination of the lectures of professors of French law in Bourges reveals that they gave no mention to law from the region of Nevers, since above all they were concerned with teaching customary law that was common to the whole country.

En 1867, les professeurs de la Faculté de droit de Dijon contestent l'interprétation que fait le ministre de l'Instruction publique du règlement de 1826 sur la comptabilité publique, règlement qui leur assurait un complément de salaire lorsque le budget de la Faculté présentait un excédent. Le ministre ayant rejeté leur requête gracieuse, les enseignants portent leur affaire devant le Conseil d'État, à l'initiative du doyen Serrigny, publiciste déjà bien connu et de caractère entier. La haute juridiction donnera raison pour l'essentiel aux enseignants dijonnais par un arrêt rendu le 27 juillet 1870 ; c'est sur cette victoire que Serrigny quittera la Faculté pour cultiver ses vignes après avoir contribué au développement du droit administratif.

When professors of law in Dijon go to court.

In 1867, the professors at the Faculty of Law in Dijon contested the interpretation of the Minister of public education concerning the ruling of 1826 about public accounting, a ruling that granted them extra pay when there was a budget surplus at the Faculty. Since the minister had rejected their request for an out of court settlement, the teaching staff took the case to the Conseil d'État, on the initiative of Dean Serrigny, who was already well known as a public law specialist of strong character. The high court for the most part ruled in favor of the teaching staff in Dijon by a decree pronounced on July 27, 1870. After this victory Serrigny was to leave the faculty to cultivate his grapevines after having contributed to the development of administrative law.

Connu comme historien du Moyen Âge, Louis Stouff a été étudiant en droit avant de s'engager dans la carrière universitaire en lettres. Ses notes de cours prises à Grenoble et probablement à Paris et à Lyon, fournissent de précieux témoignages sur l'enseignement du droit civil dans les années 1880. Sans renoncer aux vieilles méthodes exégétiques, les professeurs de Louis Stouff se sont engagés dans la voie d'une interprétation plus souple et plus ouverte du Code civil. Ils n'hésitent pas à laisser percer des opinions politiques. Les prises de position de certains d'entre eux font apparaître un milieu universitaire moins conservateur et plus sensible aux premières réformes des républicains que pourrait le laisser penser l'image traditionnelle attachée aux facultés de droit.

The teaching of civil law in the 1880's as seen through the notes taken by Louis Stouff.

Known as a historian of the Middle Ages, Louis Stouff studied law before taking up a university career teaching in a « Faculty of Letters ». The notes he took in Grenoble, and probably in Paris and Lyons, are precious evidence of how civil law was taught in the 1880's. While keeping to the old exegetic method, Louis Stouff's professors embarked down the road of a more flexible and more open interpretion of the Code civil. They unhesitatingly let their political opinions come through. Some of their points of view indicate an intellectual atmosphere that is less conservative and more sensitive to the first republican reforms than the traditional image of the Faculties of Law might lead one to think.

La généralisation de l'instruction publique primaire laïque en Suisse par la Constitution fédérale de 1874 est paradoxale, car la population est presque entièrement chrétienne. Cet événement s'explique par la conjonction de l'opposition entre catholiques et protestants avec celle entre partisans et adversaires d'un renforcement de l'État fédéral. Les adversaires de la centralisation comptaient les protestants de langue française qui craignaient une réduction de leur autonomie cantonale au profit de la population de langue allemande dominante en Suisse, quoique protestante. La généralisation de la laïcité de l'instruction publique fut un des gages donnés aux protestants de langue française pour les rallier à la réforme constitutionnelle. Le résultat fut un principe de laïcité anticatholique, mais non antichrétien. La mise en œuvre du principe de la laïcité scolaire fut confiée au Conseil fédéral. Il développa une politique nuancée dont on a retenu trois exemples : la situation des congréganistes dans les écoles, l'interdiction des écoles publiques confessionnelles et le maintien d'aspects chrétiens dans l'enseignement public.

The generalization of non-religious elementary board-school in Switzerland by the federal Constitution of 1874 was paradoxical, because the population was almost entirely christian. This event is explained by the conjunction of the opposition of roman catholics and protestants with the opposition of backers and opponents to the reinforcement of the federal State. The french speaking protestants were among the opponents to the reinforcement of the federal State, because they feared the overwhelming of the self-government of french speaking cantons by the reinforced federal power in hands of the german speaking population, that is to say the most numerous population of Switzerland, although it was protestant. The generalization of non-religious school was one of the arrangements the protestants were granted to give their support to the proposal of reinforcement of the Federal State. Accordingly, the rule of non-religious school was drawn up against catholicism, but not against Christianity. The federal Council, that is to say the federal executive, was entrusted to enforce the law of non-religious elementary board-school to cases. It worked out a toned policy from which three instances are given here : teaching by priests, friars or nuns ; forbidding of denominational board-school or private school ; christian nature of state education.

L'acte de libéralité dans la Champagne méridionale du Moyen Âge a été délaissé par les érudits ; pour remédier à cette lacune la présente communication a été élaborée à partir des actes de la pratique. Les précédents de l'Antiquité romaine et du haut Moyen Âge expliquent une évolution qui offre analogies et dissemblances avec celle qui caractérise les régions avoisinantes, Suisse francophone comprise. Les dispositions entre vifs qui lient aussitôt le disposant se différencient des legs ; elles se présentent sous diverses formes qui offrent des traits communs entre elles. C'est d'abord le don « a die presenti » qu'inspirent notamment des préoccupations spirituelles et caritatives ; les effets perpétuels du transfert immédiat sont soulignés ; qualités du consentement parfois, nature du bien cédé toujours, sont mises en évidence ; le donateur se préoccupe souvent de justifier son droit sur le bien aliéné ; l'acte est protégé contre d'éventuelles réserves des proches et contre les fautes de l'une ou l'autre partie ; la garantie due par l'aliénant est exprimée. À côté de ce don qui entraîne dépossession immédiate, s'affirment dès le milieu du xiie siècle, le don avec réserve d'usufruit et le don « post obitum » ; certes, ils possèdent bien des traits communs avec le don « a die presenti » ; mais le donataire a un droit définitif dès la confection de l'acte, il n'entre en possession qu'à la mort du disposant. Face à cette pluralité de formes, legs et testament répondent à une autre préoccupation ; le principe de la volonté ambulatoire est encore ignoré et il n'empêche que seul le décès du disposant entraîne transfert de propriété et de possession au profit du bénéficiaire avec le concours de l'exécuteur testamentaire. Des charges peuvent grever le legs. L'analyse des actes conduit à poser plus d'un problème : intangibilité de la donation, spécificité du don et du legs, introduction du caractère commutatif que dissimule mal le titre de l'acte. La rigueur des principes est à peine entrevue.

Acts of liberality in southern Champagne from the eleventh to the thirteenth century.

The act of liberality in southern Champagne throughout the Middle Ages has been neglected by scholars, which is the reason for the present paper based on acts concerning this practice. Precedents from ancient Rome and from the Middle Ages can explain a change which shows similarities and differences that are typical of neighboring regions, including French-speaking Switzerland. The provisions of donations inter-vivos which henceforth are binding to the testator can be differentiated from legacies. They exist in various forms, all of which have certain points in common. Firstly, spiritual and charitable concerns inspire a die presenti donations ; the perpetual effects of an immediate transfer are emphasized ; at times it is the qualities of consent, it is always the nature of the property transferred, which are underscored ; the donor is often concerned with proving his right to the property to be transferred ; the act is protected from possible reserves from next of kin and from errors committed by one party or the other ; the guarantee made by the donor is expressed. In addition to this donation which immediately leads to dispossession, the donation with the reserve of usufruct — and the post obitum donation are established as early as the middle of the twelfth century. Of course, they present similarities with the a die presenti donation, but although the donee has a definitive right after the drafting of the act, he only takes possession of the property at the death of the testator. Faced with the plurality of forms, legacies and testaments are the answer to another concern ; the principle of the ambulatory will is still ignored ; nevertheless only the death of the testator brings about the transfer of the property and its possession by the beneficiary through the participation of the executor. Costs can encumber the legacy. The analysis of these acts leads to more than one problem : the intangibility of the donation, the specificity of the donation and of the legacy, the introduction of the commutative character that badly dissimulates the title of the act. The rigor of the principles is hardly mentioned.

L'ascension sociale d'une famille dijonnaise de juristes, les Blanot (XVIIe-XVIIIe siècles).

Du xvie au xviiie siècle, à Dijon et dans ses environs, la famille Blanot effectue une ascension sociale marquée. Des études de droit systématiques, nécessaires pour devenir administrateur, et leurs liens de clientèle avec plusieurs princes de sang royal leur permettent d'obtenir des offices prestigieux, comme ceux de magistrats au parlement de Dijon (xviiie siècle). Cela correspond à une stratégie d'ascension sociale traditionnelle, mais il est rare d'identifier ces éléments avec autant de précisions. Cependant, les Blanot ne suivent pas le schéma classique selon lequel il n'y a pas à Dijon de statut social supérieur à celui de parlementaire. À la fin du xviiie siècle, ils optent pour une carrière militaire qui leur permet d'intégrer la noblesse sans ambiguïté. Ce choix atypique s'explique par un handicap initial, deux anoblissements avortés, et par un contexte louis-quatorzien où il faut prouver son appartenance à la noblesse.

The Blanots, a family of lawyers in Dijon, climb the social ladder from the seventeenth to the eighteenth century.

From the sixteenth to the eighteenth century in Dijon and the surrounding area, the Blanot family very noticeably climbs the social ladder. Systematic studies in the field of law, necessary to become high-ranking civil servants, and their relationships with clients of royal blood permit them to obtain prestigious offices, such as those of magistrates in the parliament of Dijon (seventeenth century). This corresponds to a strategy of social ascension but seldom can one identify these elements with such precision. However, the Blanots do not follow the usual pattern according to which no social level in Dijon is superior to that of a member of parlement. In the late seventeenth century, they choose military careers which unambiguously permits them to become part of the nobility. This atypical choice can be explained by an initial handicap, two aborted ennoblements, and a Louis XIV context where one had to prove one's membership in the nobility.

La pratique du monitoire à fin de révélation sous l'Ancien Régime, à travers l'exemple du diocèse d'Autun (1670-1790).

Le monitoire à fin de révélations est, sous l'Ancien Régime, une procédure criminelle par laquelle les magistrats obtiennent la coopération du clergé : lors de la fulmination d'un monitoire, les curés obligent leurs paroissiens à venir témoigner, sous peine d'excommunication. Le monitoire reste encore peu connu, principalement en tant que pratique judiciaire. Le monitoire a fait, au xviiie siècle, l'objet de nombreuses critiques, principalement de la part des philosophes. L'étude de 1 504 monitoires conservés par le diocèse d'Autun entre 1670 et 1790, démontre que la plupart de ces critiques ne sont pas fondées. En effet, on constate assez peu d'abus dans le recours au monitoire, qui ne peut être considéré comme une forme de délation. Cette procédure reste exceptionnelle, conformément au droit. Surtout, le monitoire relève, au xviiie siècle, d'une véritable demande sociale, principalement des dominants sociaux. Il est donc principalement utilisé contre une délinquance contre les biens (vols, infractions rurales...), alors que la législation royale limite théoriquement le monitoire aux crimes graves et scandales publics. Cependant, pénalistes et canonistes légitiment tout recours au monitoire au nom de l'autorité royale, voire divine. Le monitoire est principalement utilisé par les justices seigneuriales. Il fonctionne encore, certes de manière relative, même à la fin de l'Ancien Régime. Enfin, nous noterons que l'Église ne contrôle plus cette ancienne procédure canonique, malgré des résistances au xviie siècle.

The practice of the « monitoire » for the purpose of revealing misdeeds during the Ancien Régime as seen through the example of Autun.

The monitoire for the purpose of revealing misdeeds is, under the Ancien Régime, a criminal procedure during which magistrates obtain the cooperation of the clergy : during the denunciation stage of a monitoire, parish priests forced their parishioners to testify if they did not wish to be excommunicated. The monitoire is not well known, especially as a judicial practice. The monitoire was greatly criticized during the eighteenth century, principally by philosophers. A study of 1 504 monitoires kept in the diocese of Autun between 1670 and 1790 shows that most of these objections are not well-founded. Indeed, there can be detected very few abuses resorting to the monitoire, which cannot be considered as a form of denouncement. This procedure remains exceptional, in accordance with the law. During the eighteenth century the monitoire comes about due to real social needs, principally from the dominant social classes. Thus, it is mainly used within the scope of offences against property (thefts, rural infractions...), whereas, in theory, royal legislation limits the monitoire to serious crimes and public scandals. However, specialists of penal and canon law legitimate any use of the monitoire in the name of royal, or even divine, power. The monitoire is for the most part a practice in seigniorial law. It is still relatively in use even at the end of the Ancien Régime. Finally, it is interesting to note that the Church no longer controls the ancient canonical procedure, despite opposition during the seventeenth century.

Un conflit entre les besoins de la veuve et les droits des héritiers et des créanciers. L'augment de dot en Bugey, Valromey et Pays de Gex de 1601 à 1789.

Créé pour permettre à la veuve de subvenir à ses besoins matériels, l'augment de dot est une part de la succession du mari à laquelle les usages accordent d'abord les mêmes garanties de paiement que la dot elle-même. Mais bien vite, l'augment sert à ne pas respecter les engagements du mari envers ses créanciers. Le parlement de Dijon, solidement appuyé par la doctrine, poursuit l'œuvre du sacré Sénat de Chambéry en réduisant progressivement ce frein au développement des affaires.

A conflict between the needs of widows and the rights of heirs and creditors. The « augment » of the dowry in Bugey, Valromay and the Pays de Gex from 1601 to 1789.

Created to allow the widow to provide for her needs the augment of the dowry is a part of the inheritance left by the husband to which custom first of all granted the same guarantees as the payment of the dowry itself. But very rapidly the augment is used to escape the commitments of the late husband to his creditors. The Parliament of Dijon, strongly supported by the doctrine, continue the work of the sacred Sénat de Chambéry by progressively reducing this hindrance to the development of business.

Des conseils de préfecture aux tribunaux administratifs.

Malgré les quelques précédents que l'on peut trouver dans la France d'Ancien Régime, c'est la Révolution française qui a ouvert la voie à la création d'une juridiction administrative autonome séparée matériellement et fonctionnellement de la juridiction judiciaire. Le chemin a été long, depuis la loi du 7-11 septembre 1790 qui a confié une partie du contentieux administratif aux directoires de département, jusqu'à la création des tribunaux administratifs en 1953. À côté du rôle bien connu du Conseil d'État, il convenait d'essayer de retracer l'histoire des conseils de préfecture dont l'évolution constitue une des clés de l'épanouissement du contentieux administratif.

From « conseils de préfecture » to administrative courts.

Despite a few precedents that can be found in the France of the Ancien Régime, it was the French Revolution that opened the way to the creation of an autonomous administrative jurisdiction, physically and functionally separate from the judicial jurisdiction. It had been a long road since the law of September 7-11, 1790 that entrusted part of administrative litigation to the directoires of each department until the creation of the administrative courts in 1953. In addition to the well-known role of the « Conseil d'État », it is only right to relate the history of the conseils de préfecture whose development constitutes one of the keys to the flourishing of administrative litigation.
